These Terms of Service (the “Terms”) form a binding agreement between Bigdomainhost, a sole proprietorship of Parth Sharma with its place of business at 32 A/G-673 A, Kamla Nagar, Agra, Uttar Pradesh 282005, India (“we”, “us”, “Bigdomainhost”), and the person or entity that opens an account or buys a service (“you”, “Customer”).
By placing an order, paying an invoice or using any service, you accept these Terms together with our Acceptable Use Policy, Privacy Policy, Refund & Cancellation Policy and Service Level Agreement, each of which is incorporated by reference.
1. The services
Bigdomainhost supplies shared and cPanel web hosting, managed WordPress hosting, cloud hosting, WHM reseller hosting, KVM VPS and VDS instances, bare-metal dedicated servers, application hosting and related services from data-centre facilities in India and abroad.
Specifications published on the site — vCPU, RAM, NVMe capacity, transfer allowance — are the allocation for your plan. Shared and reseller plans operate on a fair-use basis described in clause 5.
2. Eligibility and account
- You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
- You must give accurate, current contact details, including a working email address and mobile number, and keep them updated. Notices sent to the address on file are treated as delivered.
- You are responsible for everything that happens under your account, including acts of your staff, clients and sub-users, and for keeping credentials, SSH keys and API tokens secret.
- We may ask for KYC documents (PAN, GSTIN, address proof) before activating an account or releasing a dedicated server, and may refuse or close an account that fails verification.
3. Orders, term and renewal
Services are sold for a term you choose at checkout — monthly, quarterly, half-yearly, annual or longer. Unless cancelled before the renewal date, services renew automatically for the same term at the then-current published price.
Renewal invoices are issued in advance: 15 days before renewal for hosting plans and 30 days before renewal for dedicated servers. Cancel at any time from the client area or by writing to [email protected] before the renewal date.
4. Fees, taxes and payment
- Prices published on the pricing page exclude Goods and Services Tax. GST at 18% is added to invoices for Indian customers, and a tax invoice is issued for every payment.
- We accept UPI, net banking, debit and credit cards, and bank transfer. Payment gateway charges, if any, are shown before you confirm.
- Payment is due on the invoice date. An account unpaid 3 days past due may be suspended; an account unpaid 15 days past due may be terminated and its data deleted.
- Reactivation after suspension for non-payment may attract a reactivation fee, shown on the overdue invoice.
- Registered domains, SSL certificates, third-party licences (cPanel, Windows Server, Plesk, CloudLinux, LiteSpeed, JetBackup) and setup fees are billed as pass-through costs and are non-refundable once issued.
5. Fair use on shared and reseller plans
“Unlimited” storage and bandwidth on shared, cPanel, WordPress and reseller plans mean unlimited for normal website use. They are not a licence to use the server as a file-distribution, backup, streaming or archival endpoint. In practice this means:
- A single cPanel account should stay under 250,000 inodes and use no more than the CPU, memory and entry-process limits listed for its plan.
- Files not linked from, or used by, a hosted website (media archives, backups of other systems, ISO libraries) do not count as normal website use.
- We will always contact you before acting on a fair-use breach, and will offer a VPS or dedicated plan that fits the workload.
6. Acceptable use
Your use of the services is governed by the Acceptable Use Policy. It prohibits, among other things, spam, phishing, malware distribution, child sexual abuse material, content that infringes copyright, crypto-mining on shared plans, and any activity unlawful under Indian law.
7. Uptime, backups and support
- Network and power availability are covered by the Service Level Agreement, including the credits payable when we miss it.
- Backups we take are a courtesy, not a product. You remain responsible for your own backups. We recommend keeping an off-server copy, and we sell managed backup add-ons for customers who would rather not.
- Support is available 24×7 by phone on +91 75994 50220, by email at [email protected] and on WhatsApp. Managed support covers the platform we supply; application-level debugging beyond that is best-effort or billable.
8. Suspension and termination
We may suspend or terminate a service, with notice where practical and immediately where not, if:
- an invoice is overdue as described in clause 4;
- the account breaches the Acceptable Use Policy or any law;
- the service is the source or target of an attack that threatens other customers or the network;
- we receive a valid order from a court, law-enforcement agency or a competent authority.
On termination for cause, prepaid fees are not refunded. On termination by you, the Refund & Cancellation Policy decides what is refundable.
Data on a terminated service is retained for 7 days and then permanently deleted. Ask for an export before that window closes.
9. Your content and our intellectual property
You keep all ownership of the data, code and content you place on our infrastructure. You grant us only the limited licence needed to host, transmit, back up and restore it in order to provide the service.
The Bigdomainhost name, logo, website, documentation and control panel remain ours. Nothing in these Terms transfers them to you.
10. Warranties and limitation of liability
The services are provided on an “as is” and “as available” basis. To the extent Indian law permits, we exclude all implied warranties, including merchantability and fitness for a particular purpose.
We are not liable for indirect, incidental, special or consequential loss, for loss of profit, revenue, goodwill or anticipated savings, or for loss or corruption of data.
Our total aggregate liability for any claim, in contract, tort or otherwise, is limited to the fees you actually paid for the affected service in the three (3) months immediately before the event giving rise to the claim.
Nothing here limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You will indemnify and hold Bigdomainhost and Parth Sharma harmless from claims, damages, penalties and reasonable legal costs arising out of the content you host, your breach of these Terms or the Acceptable Use Policy, or your infringement of a third party's rights.
12. Force majeure
Neither party is liable for a failure caused by something outside its reasonable control: natural disaster, fire, flood, epidemic, war, riot, strike, act of government, undersea cable cut, nationwide internet shutdown, or failure of an upstream carrier or data-centre provider.
13. Changes to these Terms
We may amend these Terms. Material changes are notified by email to the address on your account and posted here at least 30 days before they take effect. Continuing to use the service after that date means you accept the change.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Agra, Uttar Pradesh have exclusive jurisdiction, subject to the dispute-resolution step below.
Before filing anything, write to [email protected]. We will attempt in good faith to resolve the dispute within 30 days. Disputes not resolved that way may be referred to a sole arbitrator appointed by us with your consent, under the Arbitration and Conciliation Act, 1996, seated at Agra, in English.
